Consent to the personal data processing for the purposes of providing the service E-consultation

I acknowledge and agree that:

  1. The processing of my personal data is necessary for the provision of the service E-consultation, i.e. for the expert assessment by a healthcare professional (hereinafter referred to as “expert consultant”) whether I am a suitable candidate for the subsequent provision of an initial expert consultation / specialized examination at a health service provider, and as the case may be, for the purpose of intermediation of such a consultation/examination, of my choice.
  2. The legal basis for the processing of the personal data concerning my health is the fulfilment of the contract for the provision of the service E-consultation which I ask for, except for the data concerning my health where the legal basis is my consent.
  3. The consent is entirely voluntary. However, if I do not give consent, then according to the General Data Protection Regulation (GDPR) the data concerning my health cannot be processed for the purposes of providing the service, so the service E-consultation I ask for cannot be provided.
  4. The extent of the data concerning my health which have to be processed for the purposes of providing the service E-consultation is defined by the contents and structure of the questionnaire for the service E-consultation.
  5. The controller of the personal data I provide for the service E-consultation is EPC Health Invest SE, registered office: Antala Staška 1859/34, 140 00 Prague 4 – Krč, Czech Republic, ID: 04465059, registered in the Commercial Register maintained by the Municipal Court in Prague, file No. H 1645 (hereinafter referred to as “EPC”).
  6. The personal data provided by me will be processed by EPC as follows:
  • the contact data entered in the application / order of the service E-consultation (name, surname, address, e-mail and telephone, as appropriate) will be processed for the purposes of communication with me in relation to the expert assessment (receiving my order of the service, keeping a register of EPC’s customers, arranging the expert assessment, and sending me the results of the expert assessment) and, as the case may be, for the purpose of making a subsequent appointment with a health service provider for a specialized examination at my request;
  • the data concerning my health will be processed as follows: having received them, EPC will check whether the data were provided to the extent and in the quality required and sufficient for the expert assessment, and will forward the data with my consent to an expert consultant for the expert assessment.
  • For the purpose of expert assessment, EPC uses the services of expert consultants who are renowned medical specialists in the given field – MUDr. Róbert Tirpák, MUDr. Róbert Rapčan and MUDr. Štefan Harčarufka. So my personal data will be transmitted by EPC to these persons who only process them for the purposes of expert assessment whether I am a suitable candidate for an initial expert consultation / specialized examination at a health service provider. These persons are independent data controllers and process personal data in accordance with the applicable legal regulations, including the General Data Protection Regulation (GDPR).
  1. If the result of the expert assessment carried out as part of the service E-consultation is that I am a suitable candidate for the subsequent provision of an initial expert consultation / specialized examination, and if I wish EPC to make my appointment for such an examination with a health service provider of my choice, I can also require EPC to transmit to the provider all the personal data I have already provided to EPC. In such case, my repeated consent to the transmission of such data to the health service provider of my choice will not be required.
  2. My personal data will be processed for a necessary period which means the period
  • until withdrawal of my consent to the processing of personal data concerning my health, or
  • until withdrawal from the contract for the provision of the service E-consultation, or
  • until provision of the service E-consultation, i.e. until delivery of the result of the expert assessment concerning the suitability to undergo an initial expert consultation / specialized examination, whichever comes earlier. Even after expiry of the periods stated above, my personal data will continue being processed but only by retaining them for the purposes of defense of EPC against any legal claims exercised on the grounds of the provision of the service E-consultation. If I withdraw consent to the processing of personal data concerning my health or if I withdraw from the contract for the provision of the service E-consultation before the provision of the service, i.e. before the delivery of the result of the expert assessment concerning the suitability to undergo an initial expert consultation / specialized examination, none of the personal data concerning my health will continue to be retained.
  1. The personal data concerning my health will be processed by EPC with the use of the following processors which are recipients of personal data and which will process the data for EPC only to the extent stated below:

  1. Regarding the protection of my personal data, I have the following rights, in particular:
  • the right to withdraw consent to the processing of personal data concerning my health without prejudice to the legality of the processing based on the consent prior to its withdrawal; if the service E-consultation has not been provided by then, i.e. if the result of expert assessment as part of the service E-consultation has not been sent to me by then, it will not be possible to provide the service any longer. Upon withdrawal of the consent to the processing of personal data concerning my health, the obligation of EPC to provide the service E-consultation expires. If I withdraw my consent after the service has been provided – after the result of the expert assessment has been delivered, EPC will continue to retain my personal data as stated in section 7 above;
  • the right to request from EPC access to and rectification or erasure of personal data that relate to me, or restriction of their processing, as well as the right to data portability;
  • the right to object to retention of my personal data for the purposes of defense of EPC against any legal claims exercised on the grounds of the provision of the service E-consultation;
  • the right to lodge a complaint with the competent supervisory authority, e.g. Office for Personal Data Protection.
