Personal data processing in relation to the service E-consultation

  1. In order to be able to provide you with the service E-consultation, we need to process your personal data.
  2. The processing of your personal data is necessary for the provision of the service E-consultation, i.e. for the expert assessment by a healthcare professional (hereinafter referred to as “expert consultant”) whether you are a suitable candidate for the subsequent provision of an initial expert consultation / specialized examination at a health service provider, and as the case may be, for the purpose of intermediation of such a consultation/examination, of your choice. The legal basis for the processing of your personal data is the fulfilment of the contract concerning the provision of the service E-consultation you asked for.
  3. In addition, we need to have your consent to the processing of personal data relating to your health as the separate legal basis for the processing of such personal data. According to the General Data Protection Regulation (GDPR), we are not allowed to process them without such consent. So the legal basis for the processing of personal data concerning your health is your consent, which you give while ordering the service E-consultation.
  4. In order to protect your privacy and to restrict personal data processing only to the data we really need to process for the provision of the service E-consultation, please send (give) us only those personal data we expressly ask you for.
  5. The controller of your personal data you provide to us for the service E-consultation is EPC Health Invest SE, registered office: Antala Staška 1859/34, 140 00 Prague 4 – Krč, Czech Republic, ID: 04465059, registered in the Commercial Register maintained by the Municipal Court in Prague, file No. H 1645 (hereinafter referred to as “EPC”).
  6. The personal data provided by you will be processed by EPC as follows:
  • the contact data entered in the application / order of the service E-consultation (name, surname, address, e-mail and telephone, as appropriate) will be processed for the purposes of communication with you in relation to the expert assessment (receiving your order of the service, keeping a register of our customers, arranging the expert assessment, and sending you the result of the expert assessment) and, as the case may be, for the purpose of making a subsequent appointment with a health service provider for a specialized examination at your request;
  • the data concerning your health will only be processed as follows: having received them, we will check whether the data were provided to the extent and in the quality required and sufficient for the expert assessment, and we will forward the data with your consent to an expert consultant for the expert assessment.

For the purpose of expert assessment, our company uses the services of expert consultants who are renowned medical specialists in the given field – MUDr. Róbert Tirpák, MUDr. Róbert Rapčan and MUDr. Štefan Harčarufka. So your personal data will be transmitted by EPC to these persons who only process them for the purposes of expert assessment whether you are a suitable candidate for an initial expert consultation / specialized examination at a health service provider. These persons are independent controllers of your personal data and process personal data in accordance with the applicable legal regulations, including the General Data Protection Regulation (GDPR).
  2. If the result of the expert assessment carried out as part of the service E-consultation is that you are a suitable candidate for the subsequent provision of an initial expert consultation / specialized examination, and if you wish EPC to make my appointment for such an examination with a health service provider of your choice, you can also require EPC to transmit to the provider all the personal data you have already provided to us. In such case, we will not need your special consent for the purpose of the transmission of such data to the health service provider of your choice.
  3. We will process your personal data for a necessary period which means the period
  • until withdrawal of your consent to the processing of data concerning your health, or
  • until withdrawal from the contract for the provision of the service E-consultation, or
  • until provision of the service E-consultation, i.e. until delivery of the result of the expert assessment concerning the suitability to undergo an initial expert consultation / specialized examination, whichever comes earlier. Even after expiry of the periods stated above we will continue processing your personal data but only by retaining them for the purposes of defense of EPC against any legal claims exercised on the grounds of the provision of the service E-consultation. If you withdraw consent to the processing of personal data concerning your health or if you withdraw from the contract for the provision of the service E-consultation before the provision of the service, i.e. before the delivery of the result of the expert assessment concerning the suitability to undergo an initial expert consultation / specialized examination, none of the personal data concerning your health will continue to be retained.
  1. You have the right to withdraw your consent to the processing of personal data concerning your health at any time. Withdrawal of your consent is without prejudice to the legality of the processing based on the consent prior to its withdrawal. If the service E-consultation has not been provided by then, i.e. if the result of expert assessment as part of the service E-consultation has not been sent to you by then, we will not be able to provide the service to you any longer. Upon withdrawal of your consent to the processing of personal data concerning your health, our obligation to provide the service E-consultation expires. If your consent to the processing of personal data concerning your health is withdrawn after the service has been provided – after the result of the expert assessment has been delivered, our company will continue to retain your personal data as stated in section 8 above.
  2. We process your data with the use of the following processors which are recipients of personal data and which will process the data for EPC only to the extent stated below:

  1. Regarding the protection of your personal data, you have the following rights, in particular:
  • the right to withdraw consent to the processing of personal data concerning your health without prejudice to the legality of the processing based on the consent prior to its withdrawal;
  • the right to request from EPC access to and rectification or erasure of personal data that relate to you, or restriction of their processing, as well as the right to data portability;
  • the right to object to retention of your personal data for the purposes of defense of EPC against any legal claims exercised on the grounds of the provision of the service E-consultation.
  • the right to lodge a complaint with the competent supervisory authority, e.g. Office for Personal Data Protection.
